Terms of Service
Welcome to Eagle Connection Center (“the Platform”), accessible at eagleconnectioncenter.com. These Terms of Service govern your use of the Platform, including any content, features, and services provided through the Platform. By accessing or using the Platform, you agree to comply with these Terms of Service. If you do not agree with these terms, please refrain from using the Platform.
1.1 Eligibility: Access to the Platform is limited to authorized franchisees, corporate staff, and coaches affiliated with Eagle Transmission. By using the Platform, you confirm that you are an authorized user.
1.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and ensuring their appropriate use. Any activity that occurs under your account is your sole responsibility.
1.3 Compliance with Laws: Users must comply with all applicable laws and regulations while using the Platform. Prohibited activities include, but are not limited to, engaging in illegal or fraudulent activities, infringing upon intellectual property rights, and violating the privacy or rights of others.
2.1 Ownership: The Platform and its contents are owned by Eagle Transmission. All intellectual property rights related to the Platform, including but not limited to trademarks, copyrights, and trade secrets, are the property of Eagle Transmission or its licensors.
2.2 User-Generated Content: Users may contribute content to the Platform, such as posts, discussions, and other materials (“User Content”). By submitting User Content, you grant Eagle Transmission a non-exclusive, worldwide, royalty-free license to use, modify, reproduce, and distribute the User Content within the Platform for the purposes of operating and promoting the Platform.
2.3 Prohibited Content: Users must not upload, post, or transmit any User Content that is unlawful, defamatory, abusive, harassing, obscene, or otherwise objectionable. Eagle Transmission reserves the right to remove or restrict any User Content that violates these terms.
3.1 Availability: The Platform may provide access to training materials, courses, and other educational resources (“Training Materials”). The availability of Training Materials may be subject to additional terms and conditions.
3.2 Non-transferable: Access to Training Materials is granted solely to authorized users and may not be transferred, shared, or distributed to unauthorized individuals.
4.1 Data Collection and Usage: Eagle Transmission collects and processes user data in accordance with its Privacy Policy. By using the Platform, you consent to the collection, storage, and processing of your personal information as described in the Privacy Policy.
4.2 Security: Eagle Transmission takes reasonable measures to protect user data; however, no data transmission over the internet can be guaranteed as 100% secure. Users are responsible for taking appropriate measures to protect their own information and should report any suspected security breaches to Eagle Transmission.
5.1 Disclaimer: The Platform and its contents are provided on an “as is” basis without any warranties, express or implied. Eagle Transmission disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
5.2 Limitation of Liability: Eagle Transmission shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with your use of the Platform, including any loss of data, business, or profits, regardless of the cause of action.
Eagle Transmission reserves the right to terminate or suspend access to the Platform at any time, with or without cause and without prior notice.
Eagle Transmission may modify these Terms of Service at any time by posting the updated version on the Platform. Your continued use of the Platform after any such modifications constitutes your acceptance of the revised terms.
These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which Eagle Transmission is located, without regard to its conflict of law principles.
